The Terms and conditions for all users and persons advertising or intending to advertise on enduranceGB website.

The Content of the Advertisements

1.      The Content of the advertisements are made up from information supplied by the advertiser.

2.      The web site is updated on a regular basis. However, we offer no guarantee or warranty as to the quality, accuracy, completeness, performance, fitness for a particular purpose of the Site or any of its contents or the frequency that the site is updated.

3.      Neither EnduranceGB, nor eShopHost Ltd (their agent) shall be liable for any damages without limitation, damages for any consequential loss or loss of business opportunities or loss of profits in any form that may arise from the use of or inability to use the site, or any of its contents, or from any action, omission, error taken as a result of using the site or any of its contents.

4.      The site contains advertising material in the form of intended advertisements submitted to us by third party advertisers and no liability or responsibility for the content or accuracy of such adverts is accepted. There are no guarantees or warranties offered or implied regarding the contents of this site in respect of the existence, availability, specification or intended use of any article advertised whatsoever on the site.

5.      There is no warranty offered or even implied that the contents of the site are free from any virus or other electronic or IT or other deficiency which has a contaminating, destructive or other negative effect upon any other individuals or business systems and we shall have no liability whatsoever in this event.

6.      We accept no liability whatsoever for any item or product advertised on this site and potential purchasers should satisfy themselves that the item advertised is both suitable and safe for the use intended and that the advertiser is the legal owner of the item and has the right in law to dispose of the item.

7.      All advertisers much ensure that the product they are advertising is legally allowed and we reserve the right without supplying any reason to reject or refuse to advertise any item whatsoever.

8.      All liability is excluded to the extent permitted by law including any implied terms.

9.      All photographs used on the site must have the prior consent of the owner of the negatives or the photographer or of the person who owns the image rights before they are submitted to us for use. The site cannot be held responsible for any issues arising due to copyright protection of photographs and any legal costs or actions against the site will be pursued against any advertiser who fails to comply with the instructions and terms provided with regard to this subject.

10.  We accept adverts totally at our own discretion and we reserve the right to reject any advert for failing to comply with our terms and conditions, if we suspect that any item may not be suitable to be offered for sale or suspect that we may commit an offence by advertising any item or it may harm our credibility or reputation. We reserve the right not to have to give any reason for rejecting any advertisement.

11.  Any advertiser/individual/business/company/sole trader who we deem to be unsuitable to advertise on our site will be notified by email that we are exercising our right to refuse them to advertise.

12.  We reserve the right to remove any advertisement from the site without notice for any reason and the advertiser will be notified by e mail immediately this is done.

13.  We reserve the right to retain any monies by an advertiser paid for the placing of an advert who then in our view following the placement of the advert we believe to be in breach of any of our terms and conditions.

14.  At our discretion refunds will be made if we believe that any breach of our terms and conditions was not done so knowingly or with intent by the advertiser.

15.  We are not liable for any costs or other expenses arising as an advertiser having their advert withdrawn or any subsequent consequential losses that may be alleged.

16.  We reserve the right to advise any individual/advertiser/business/company/sole trader that we will not accept any future adverts from them without supplying a reason.

17.  Normally once a submission has been received and processed and the listing is live on the site refunds will not be given. However, in exceptional circumstances and at our discretion a refund may be made minus a processing fee of 50% of the listing cost. If an advertiser has already been advised previously that a submission is not suitable for listing and it is submitted again, under these circumstances no refund will be made.

18.   EnduranceGB have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings, the ability of sellers to sell or the ability of buyers to buy. Do not assume that the sale or purchase of any item is valid and legal simply because it is listed on this website. We are not responsible and accept no responsibility for ensuring that buyers and sellers actually complete a transaction. You accept sole responsibility for the legality of your actions under laws applying to you.

19.  We cannot confirm the purported or alleged identity of users on the site or the validity of the information which users post on our website

20.  In the event that you have any right, claim or action against any other user arising from that user's use of our website, you agree to pursue such right, claim or action independently of and without recourse to us, and you release EnduranceGB and eShopHost Ltd from all claims, liability, damages, losses, costs and expenses, including legal fees, known and unknown, arising from or in any way connected with such right, claim or action either at this time or anytime in the future.

21.   Our services and obligations to you will commence only upon receipt of your advert by us, and you at this point have agreed to sell an item and pay the relevant charge for advertising at this point.

                                                               i.      The submission you make to us that is transferred into a listing must not:

                                                             ii.      be offensive or menacing, abusive, defamatory, or in breach of copyright, confidence, privacy or any other rights.

                                                            iii.      infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy.

                                                           iv.      be fraudulent or illegal or involve the sale or offer of sale of counterfeit or stolen items.

                                                             v.      be in breach of any applicable laws or regulations.

                                                           vi.      be false, inaccurate or misleading in any form.

                                                          vii.      create any liability for us or cause us to lose either in whole or in part the services of our ISP's or other suppliers or agents.

                                                        viii.      contain any computer viruses, macro viruses, Trojan horses, worms or anything else designed or intended to interfere with, interrupt or disrupt the normal operating procedures of a computer or to surreptitiously intercept, access without authority or expropriate any system, data or personal information in any manner or even attempt to.

                                                           ix.      cause this website to be interrupted, damaged, rendered less efficient or such that the effectiveness or functionality of this website is in any way impaired or damaged or rendered unfit to fulfill the use it was designed for.

22.  We do not guarantee in any form the continuous, uninterrupted or secure access to our services. The operation of our website may be interfered with by numerous factors that may be outside of our control. Our website and our services are provided "as seen" "as are/is" and as and when available, and to the extent allowable by law.

23.  We offer no guarantees or warranties, implied or otherwise and this covers our services, skills and administration procedures. We shall always continue to operate the service and the site to the best of our abilities within what can be termed as reasonable.

We also have no liability of any sort (including liability for negligence) for the acts or omissions of other providers of telecommunications services or for faults in or failures of their networks and equipment.
A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement but this does not affect any right or remedy of a third party which exists or is available apart from that Act.

27.  If you do not understand any part of this agreement that you are automatically entering into in using our services then prior to agreeing to them, which in operational terms means forwarding your submission to us for listing. We strongly advise that you seek legal advice at your own expense or failing this refrain from using the services or entering into an agreement by using the site.

28.  This Agreement shall be governed by and construed in accordance with English law.
